Challenges from GST Authority over Relieved Company Subsidiary in ₹1.36 Crore Case

GST Authority has approached the Goods and Services Tax Appellate Tribunal against the previous order in favor of Abacus Real Estate Private Limited which is the wholly owned subsidiary of Kalpataru Limited. 

The issue concerns the transitional credit demand of ₹1,35,66,011 for the period from July 1, 2017 to March 31, 2018 along with interest as well as penalty in equivalent amount. 

The dispute has been raised on May 27, 2024, by Adjudicating Authority of the Hyderabad GST Commissionerate. 

The appeal against the above-mentioned order was filed by Abacus against the same order. This was allowed by the Principal Commissioner (Appeals-I), Hyderabad GST Commissionerate on January 29, 2026. 

The GST Authority is now approaching the GST Appellate Tribunal against the order made on January 29, 2026. 

Kalpataru mentioned that Abacus will defend the case and expects favorable result. The company doesn’t foresee any impact of this matter on their business. 

The information regarding the above appeal was received by Kalpataru from its subsidiary on September 16 at 12:47 PM and disclosed the matter to the stock exchanges including BSE and National Stock Exchange on September 17.
